Course/Module description:
Toleration is perceived as a central value in multicultural democratic societies. It is mentioned, for example, in the context of controversial religious practices such as wearing a veil, gender segregation on public transportation, and secular practices such as gay pride parades and pornography. In the seminar we will learn the various interpretations and justifications given to the concept of toleration in political philosophy. Then we will explore the different interpretations given to the concept of toleration in Israeli rulings primarily on issues of religious freedom, offences to feelings and pornography. We shall discuss the relationship between toleration and freedom of expression, freedom of religion and the right to equality. For example, freedom of expression is often justified in the name of toleration, but is also limited on behalf of that value. Toleration is often justified in the name of equality between individuals who hold different values. We will explore whether equality justifies only passive toleration, which is expressed mainly by negative liberties, or whether equality also justifies active toleration by the state, which may deprive expressions and practices that violate equality and exclude vulnerable groups in society. In addition, toleration is often understood as derivative of the right to religious freedom, but the practices of certain religious groups, allegedly protected by the right to religious freedom, do not accommodate the right to religious freedom of other groups.

2.הצגת פרו-סמינריון המהווה גם רפרט בפני כל הסטודנטים והסטודנטיות בכיתה.
3. ניתוח ביקורתי של הוראות משפטיות המעמתות בין ערכים דמוקרטיים.
