הקורס יעסוק בדיני לשון הרע במשפט הישראלי ובמסגרתו נדון בעקרונות היסוד ובשאלות התיאורטיות בסוגיית לשון הרע, לצד דיון בצדדים המעשיים ובדילמות המתעוררות בניהול משפטי לשון הרע. הקורס יבחן את יסודות העוולה האזרחית והעבירה הפלילית של פרסום לשון הרע, את התנאים לתחולתן של ההגנות העומדות למפרסמי לשון הרע ואת הסעדים העומדים לנפגע. הקורס יסקור בעיות קונקרטיות הנוגעות לפרסומים על אנשי ציבור, לפרסומים באמצעי התקשורת ובאינטרנט וכן את מגמות היסוד בפסיקה ובחקיקה, הנוגעות להיקף האחריות בלשון הרע.

Learning outcomes - On successful completion of this module, students should be able to:
The graduates of the course are supposed to be able to analyze any event concerning Defamation and to determine whether the relevant facts constitute the Tort or Offense of Defamation and whether in view of the facts, one of more of the privileges under the Law (Truth, Absolute Privileges, Qualified Privileges) shall apply and what are the remedies that could be at the disposal of the injured party.

• The interpretation of the publication.
• The Defamatory statement.
• The required mental status in the Tort and the Offense.
• The privilege of Truthful publication.
• The Absolute Privileges.
• Privileged Occasions (the Privileges of Duty or Interest).
• The Privilege of Opinion.
• The Good-Faith requirement in Section 15 Privileges.
• False factual publications in the media (the Plony v. Dayan precedent)
