Course/Module description:
The course will provide students with the fundamentals of criminal procedure by way of both understanding the fundamental justifications behind the law and the know-how practices of the discipline.

Course/Module aims:
The course will introduce students to the principles of Israeli criminal procedure, and will give the students tools to critically examine its development in recent years.

Learning outcomes - On successful completion of this module, students should be able to:
1. Identify and locate rules and doctrines (primarily legislation and case law) governing criminal procedure in Israel.
2. Descriptively and normatively analyze complex issues in criminal procedure, applying the relevant doctrines and legal policy considerations.
3. Articulate textual, interpretative, and policy arguments for and against different legal propositions.
4. Critically evaluate the underlying principles of criminal procedure, legislation, case law, current practice, and proposals for reform.

Course/Module Content:
1. Introduction - Israeli Criminal Procedure and Basic Law: Human Dignity and Liberty
2. The criminal investigation
3. The right to silence and the right to counsel
4. Detention for investigation
5. Gag orders regarding name of suspect and details of the investigation
6. Search and seizure
7. Indictment: Hearings, closing a criminal case and the decision to indict, the right to inspect the evidence, detention until the end of proceedings
8. The criminal trial: Preliminary arguments and the defendant's response to the facts of the indictment, the right to counsel, plea bargaining
9. The status of the victim in the criminal trial
10. The finality principle and its exceptions: re-trial, re-hearing, and pardon

Written / Oral / Practical Exam 100 %
