תאור כללי של הקורס:
קורס זה בוחן את המשמעויות והשימושים במושג 'כבוד האדם' בשיח המשפטי דרך בחינה משווה של הנושא. נתחיל את הקורס בזיהוי המקורות האינטלקטואלים של מושג כבוד האדם ובמיפוי משמעויותיו. נבחן גישות והתפתחויות בשימושים בכבוד האדם במחצית השנייה של המאה העשרים במסמכים לאומיים ובין-לאומיים. נלמד את העקרונות של ניסוח סעיפי חוקים וחוקות וניישמם בהקשר של מושג כבוד האדם. נלמד גישה פסיכולוגית להבנת משמעותו של כבוד האדם והבנת הפרותיו של כבוד האדם כהפחתת הערכה העצמית (self-esteem) של האדם. דגש מיוחד יינתן למשמעויות והשימושים של כבוד האדם בישראל לאחר שהוגדר כזכות חוקתית, ולהשלכות החוקתיות, הפרשניות, והפוליטיות של מהלך זה. בחלקו האחרון של הקורס נבחן את השימושים המשפטיים של כבוד האדם בהקשרים של בארגונים בטחוניים (צה"ל, משטרה, בתי סוהר) וגם בהקשרים של ביואתקיה ובאתיקה רפואית.

מטרות הקורס:
להכיר ולהבין את השימושים והמשמעויות השונים של מושג כבוד האדם בשיח המשפטי.
ללמוד לנתח שימושים משפטיים שונים באופן מורכב וביקורתי.

תוצרי למידה :
בסיומו של קורס זה, סטודנטים יהיו מסוגלים:
1. להכיר את ההיסטוריה וההתפתחות של מושג כבוד האדם.
2. להכיר ולזהות שימושים ומשמעויות שונים של כבוד האדם.
3. להכיר גישות שונות למושג כבוד האדם.
4. להכיר תחומים שונים בהם מיישמים את המושג.
5. לדעת לנתח בצורה מורכבת וביקורתית את מושג כבוד האדם בפסיקות ובכלים משפטיים.
6. לדעת לנסח סעיפי חוקות הכוללים את מושג כבוד האדם.
