תאור כללי של הקורס:
לקורס שלושה חלקים. החלק הראשון מציג את הרעיון של זכויות אדם מפרספקטיבה היסטורית, פילוסופית, אנליטית וביקורתית. מוקד הדיון בחלק זה של הקורס הנו התפתחות דיני זכויות האדם במשפט הבינלאומי תחת מסגרת ארגון האו"ם, והשלכות התפתחות זו על המשפט הבינלאומי ועל הפוליטיקה הבינלאומית. החלק השני של הקורס, המהווה את חלק הארי שלו, מוקדש לבחינה של מושגים ושל רעיונות מרכזיים מתחום זכויות האדם במשפט הבינלאומי, ולימוד אופן יישומם בהקשרים משפטיים ספציפיים, לרבות במסמכים ספציפיים (כגון אמנות והכרזות). בין הנושאים שייבחנו בחלק זה ניתן למנות את החובות הנגטיביות והפוזיטיביות של מדינות, תחולה אקסטרה-טריטוריאלית של זכויות אדם, הסתייגויות, חריגה מזכויות בשעת חירום ובזמן מלחמה וזכויות קבוצתיות. החלק השלישי והאחרון של הקורס בוחן את מנגנוני האכיפה שהתפתחו ברמה הגלובלית וברמה האזורית.

מטרות הקורס:
1. לחשוף את התלמידים למגמות העיקריות, לדילמות המרכזיות ולעקרונות דיני זכויות האדם במשפט הבינלאומי.
2. לעודד תלמידים לחשוב בצורה ביקורתית על התיאוריה של זכויות האדם, ועל אופן יישום התיאוריה, הלכה למעשה, ברמה הלאומית והבינלאומית.
3. ליצור תשתית ידע לקורסי המשך ולעבודות מחקר בתחומי דיני זכויות האדם במשפט הבינלאומי.

תוצרי למידה :
בסיומו של קורס זה, סטודנטים יהיו מסוגלים:
1. זיהוי הנורמות והמוסדות המרכזיים בתחום זכויות האדם במשפט הבינלאומי והבחנה ביניהם.
2. היכרות עם שיטת המיון של זכויות לפי דורות שונים ויכולת לחשוב בצורה ביקורתית על תקפות המיון ועל היעילות שבו.
3. היכרות עם הדילמות המהותיות העיקריות של תחום זכויות האדם.
4. היכרות עם המגמות ההיסטוריות המרכזיות בתולדות התפתחותם של דיני זכויות האדם.
5. מתן כלים שיאפשרו לקיים דיון ביקורתי ביעילותם של דיני זכויות האדם במשפט הבינלאומי.
6. יצירת מודעות לממשק בין דיני זכויות האדם הבינלאומיים לבין הפוליטיקה הבינלאומית.
7. עידוד תובנות בדבר הקשר בין דיני זכויות האדם ברמה הבינלאומית לבין הדינים החלים ברמה הלאומית.

Topic 1:
Historical and Ideological Foundations
This topic explores the concept of "human rights" in law and philosophy, and gives an overview of the historical developments of international human rights law.
Topic 2:
The UN Human Rights System
This topic introduces the different institutions and procedures created under UN auspices to advance human rights reasons: Charter bodies (including the Human Rights Commission and Council and the Special Rapporteurs) and Treaty Bodies. We will also discuss UN General Assembly and Security Council responses to human rights violations.
Topic 3:
The ICCPR Framework Provisions
These topic discusses framework provisions of the International Covenant on Civil and Political Rights: the jurisdictional (extra-territorial) clause, the existence of positive obligations, the incorporation clause and the derogation clause. Through this prism, the promise and limits of human rights law will be critically evaluated. Special attention will be afforded to the question of the applicability of human rights in times of armed conflict.
Topic 4:
The Prohibition against Torture
This topic addresses the prohibition against torture under international law as a paradigmatic example of right absolutism. It discusses the moral and policy arguments in favor of the absolute ban on torture and the interpretative pressures this construction generates.
Topic 5:
Economic and Social Rights
The topic discusses the development of second generation rights and discusses the traditional criticism directed against recognizing such rights or their justiciability. Special attention will be afforded to the principle of indivisibility and to recent reforms in ESR monitoring procedures.
Topic 6:
Women’s Rights
This topic discusses women’s rights, and focuses on issues such as violence against women.
Topic 7:
Group Rights, Minority Rights and Self-Determination
The topic discusses the justifications for developing group rights and the tension group and individual rights. Special attention will be given to the following categories of group rights: rights of national minorities and the rights of indigenous peoples.
Topic 8:
Corporations and Human Rights
This topic introduces the different questions of corporations as baring responsibilities for human rights, and the responsibilities of states to ensure that corporations do not violate human rights.
Topic 9:
International Criminal Law
This topic gives a historical introduction to the development of international criminal law, and discusses the International Criminal Court and the substantive international criminal law.

Regional Human Rights Systems
This topic introduces the three regional human rights systems, and discusses the particularities of each system.
Topic 11: Contemporary Criticism of Human Rights
This topic discusses contemporary criticisms and empirical studies about the effectiveness of international human rights law.
